There are actually two questions here. First, do you have the right to take the photograph. Second, do you have the right to publish the photo.

The answer to the first question is probably yes, Assuming you were invited to the gathering and were openly photographing you were not violating any (USA) law. You were not violating anyone’s right to privacy since many other people were present.

The answer is also probably yes to the second question. Publishing a accurate photo of one or more persons at a birthday party is not unlawful. You stray into gray territory, however, if you use the photos in some sort of narrative that is untrue or places the persons in a “false light” (or if you use the photo in an advertisement for a particular product or service).

There are many good discussions of legal issues surrounding photography and publishing on the ‘net.

Help!!!

I was using BS working on a 108 page photo book. I uploaded a jpg file to add to my library of images. I suddenly noticed the rest of the images in the library had vanished.  When I tried to reload the book I was working on it had disappeared—as had ALL OF MY OTHER BOOKS! Booksmart showed no books… I tried restarting my computer, tried reinstalling the BS software, tried downloading the software and reinstalling. Nothing has helped. When I made a "test book" BS was able to find it, but still did not show any of my five books. As far as I can tell the book date is still on the computer. At least the photo libraries appear to be…

Any help will be so gratefully appreciated. If this is a BS bug and CAN’T be fixed then I will have to leave. I’ve got about twenty hours in the books I can no longer access.
